Respect for Intellectual Property

BAC respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and respond to notices of alleged copyright infringement in accordance with applicable law.

If you believe that content on BrokerAgentCouncil.com infringes your copyright, please follow the process outlined in Section 2 below to submit a formal DMCA takedown notice to our designated agent.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on our Site in a way that constitutes copyright infringement, please provide our DMCA Agent with a written notification containing all of the following:

  • (a)A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • (b)Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered, a representative list.
  • (c)Identification of the material that is claimed to be infringing and its location on the Site (including URL or other specific description sufficient to locate the material).
  • (d)Your contact information, including name, address, telephone number, and email address.
  • (e)A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • (f)A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please note: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure your notice is accurate and submitted in good faith.

Counter-Notification

If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA Agent. A valid counter-notification must contain all of the following:

  • (a)Your physical or electronic signature.
  • (b)Identification of the material that has been removed or disabled, and the location at which the material appeared before it was removed or disabled.
  • (c)A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • (d)Your name, address, telephone number, and email address.
  • (e)A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, the judicial district of Middle District of Tennessee; and that you will accept service of process from the person who provided the original DMCA notification.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party and may restore the removed material in accordance with DMCA procedures, typically within 10–14 business days, unless the copyright owner files a court action seeking to restrain reinstatement.
