The Broker Agent Council ("BAC," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and protect your information when you visit BrokerAgentCouncil.com and interact with our services.
This Privacy Policy applies only to BrokerAgentCouncil.com. If you also use IREIA.org (the standards and certification authority) or IREIA.com (the Trusted Transaction Network marketplace), please review their separate Privacy Policies, as those sites are operated by separate entities with their own data practices.
Information We Collect
1.1 — Information You Provide Directly
We collect information you voluntarily provide when you: (a) create an account or enroll in the Deal Scout Certification program; (b) complete forms, surveys, or applications; (c) make a purchase or payment; (d) contact us for support or inquiries; (e) participate in community forums, coaching calls, mastermind groups, or events; or (f) apply for certification or continuing education.
This information may include: name, email address, phone number, and mailing address; real estate license number, state of licensure, and brokerage affiliation; payment and billing information (processed through third-party payment processors); professional history and transaction experience; profile information, photographs, and biographical details; communications with us, including support tickets and feedback; and any other information you choose to provide.
1.2 — Information Collected Automatically
When you access our Site, we automatically collect certain information, including: IP address and approximate geographic location; browser type, device type, and operating system; pages viewed, links clicked, and time spent on the Site; referring and exit URLs; date and time of access; cookie identifiers and similar tracking technologies (see our Cookie Policy); and usage data and feature interactions.
1.3 — Information from Third Parties
We may receive information about you from third-party sources, including: payment processors (transaction confirmation, not full payment details); identity verification services; and social media platforms (if you connect your account or interact with us through social media).

(a) operate, maintain, and improve the Site and our certification programs; (b) process enrollment, certifications, and payments; (c) deliver training content, educational materials, and continuing education; (d) provide coaching, community access, and member support; (e) issue and manage the Deal Scout Certification credential and Trust Seal; (f) communicate with you regarding services, updates, and obligations; (g) send marketing communications about programs and services (with opt-out available); (h) detect, prevent, and address fraud, security issues, and technical problems; (i) comply with legal obligations and enforce our agreements; and (j) conduct research and analysis to improve our programs.
How We Share Your Information
3.1 — With IREIA.org (Standards Body)
BAC is an authorized IREIA Certification Body. As part of this relationship, we share the following limited information with IREIA.org: your name, certification designation, certification status (active, suspended, lapsed, revoked), and geographic service area. This data is shared for the purpose of maintaining the IREIA public directory of certified professionals, verifying certification credentials, and administering ethics and standards compliance. IREIA.org's use of this data is governed by IREIA.org's own Privacy Policy.
3.2 — With IREIA.com (TTN Marketplace)
If you participate in the IREIA Trusted Transaction Network marketplace, BAC shares certification verification data with IREIA.com, limited to: your certification status, designation, and Trust Seal status. This sharing is for the purpose of verifying your marketplace eligibility. BAC does not share your personal contact information, payment data, or training records with IREIA.com. Any additional data you provide to IREIA.com is governed by IREIA.com's own Privacy Policy.
3.3 — Service Providers
We share information with third-party service providers who perform services on our behalf, including payment processing, email delivery, hosting and cloud infrastructure, analytics, customer support, learning management, and CRM/marketing automation (GoHighLevel). These providers are contractually obligated to use your information only as directed by us and to maintain appropriate security measures.
3.4 — Legal Requirements
We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to: (a) comply with applicable law or respond to valid legal process; (b) protect our rights, property, or safety, or that of our users or the public; (c) detect, prevent, or address fraud, security issues, or technical problems; or (d) enforce our agreements.
3.5 — Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or similar event, your information may be transferred to the successor entity. We will notify you of any such change.
3.6 — Aggregated and Anonymized Data
We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you for any purpose, including research and program improvement.
Data Security
We implement commercially reasonable administrative, technical, and physical security measures designed to protect your personal information. However, no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security.
Data Retention
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Certification records may be retained for longer periods as required for credential verification and regulatory compliance.
Your Rights and Choices
6.1 — Access and Correction
You may access and update your account information through the member portal at any time. You may request a copy of the personal information we hold about you by contacting us at [email protected].
6.2 — Deletion
You may request deletion of your personal information, subject to certain exceptions (such as information required for legal compliance, active certification records shared with IREIA.org, or pending transactions). Deleting your information may result in the termination of your certification and program access.
6.3 — Marketing Opt-Out
You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any marketing email, updating your communication preferences in the member portal, or contacting us directly. Opting out of marketing communications does not affect administrative or transactional communications.

State-Specific Privacy Rights
7.1 — California Residents (CCPA/CPRA)

7.2 — Other State Privacy Laws

Children's Privacy
The Site and our services are not directed to individuals under the age of eighteen (18). We do not knowingly collect personal information from children. If we learn that we have collected information from a child, we will promptly delete it.
International Users
The Site is operated in the United States. If you access the Site from outside the United States, you consent to the transfer, processing, and storage of your information in the United States.
